Terms & Conditions

Introduction

You have been provided with access to this System and Service either:

a: you are a Registered Employee of an Organisation who has purchased the System in order to offer you Courses and training Services. Details are specified in the Agreement between SkillGate and your Organisation
b: you are a Review User

This document specifies the terms and conditions under which you, as an individual User, agree to access and use the SkillGate System and Service.

Definitions

“Agreement” means the agreement between SkillGate Ltd and your organisation.
A “User” is any named individual who has access to the System.
“Review User” is an individual user who has access to the system for the purposes of evaluating the suitability of the content.
“Organisation” is an organisation which has paid a subscription fee to allow its Registered Employees to use The System for the puposes of education.

“Registered Employee” means an employee or contractor of the Organisation who has been registered to use The System by completion of the on-line registration process provided by The System.

“The System” means the software and content provided via any SkillGate website to The Organisation and Users.
“Course” is the general name given to the different learning delivery mechanisms used by The System.
“The Service” means the provision of The System and Courses to the Organisation by SkillGate.

“Intellectual Property Rights” means the copyright and other intellectual property rights owned by or licenced to SkillGate in the System, the Services and the Service Materials and licensed to the member by SkillGate
“SkillGate” means SkillGate Ltd, Gabem House, Heyshott Street, Heyshott Nr. Midhurst, West Sussex, GU29 0DP. Company Number 03647432

“Personal Data” has the meaning set out in the Data Protection Act 1998 and relates only to personal data of which the Organisation is the data controller (as such term is defined in the Data Protection Act 1998) and in relation to which SkillGate is providing services under this Agreement

“Processing” and “Process” has the meaning set out in the Data Protection Act 1998.

Terms of Use

1. As a User you have a non-exclusive licence in respect of The System to access the Courses and Services for as long as the Agreement is in force. Accessing the System means that you agree to the following:

1.1.You agree to use the system and the service for your personal use only.
1.2 You agree not to assign or transfer your rights to use this System.
1.3 You agree not to store copy or transfer any of the content of The System apart from your personal learning use.
1.4 You agree to only print content for your personal learning use.

Review Users

2. Review Users may access the System for the purpose of the assessment of suitability of the System or Courses.
2.1 SkillGate reserves the right to accept users as Review Users at its sole discretion, and may withdraw access at any time without notice.

Personal Data

3. Details of the way data is used, and who can access this data, is included in the Privacy Statement.

3.1. SkillGate shall process all Personal Data strictly in accordance with the terms of the Agreement and shall not process the Personal Data for any other purpose or purposes.
3.2. SkillGate will not share Personal Data with any third party except in so far as may be detailed in the Privacy Statement or the Agreement.
3.3. Personal Data will be kept and Processed as per the GDPR regulations.
3.4 Review User’s data will be deleted immediately on instructions from the Review User.

Warranties

4.1 SkillGate shall use its best endeavours to ensure the completeness and accuracy of any content before placing the same on the System.
4.2 The content of Courses (save those Courses written specifically at the request of the Organisation) has not been written to meet the individual requirements of the Organisation and is supplied on a generic basis. No failure of any part or the whole of the Courses (save those Courses written specifically at the request of the Organisation) to be suitable for the Users’s requirements shall give rise to any right or claim against SkillGate or the Organisation.
4.3. Subject to clause 4.2 above, the User accepts that SkillGate is in no way liable for any inaccuracies or misleading statements or representations made in any content supplied by SkillGate.

Intellectual Property

5.1 All data entered on The System by the Organisation including but not limited to email addresses and activity results shall remain the property of the Organisation and SkillGate shall not use such data save to comply with its obligations under this Agreement.
5.2 Nothing that the User does or is entitled to do under the terms of the Agreement or otherwise shall transfer ownership of any Intellectual Property Rights to the Organisation or the User.
5.3 SkillGate warrants that the supply of The Service will not infringe any third party intellectual property rights or other proprietary right.

General

6. Whilst SkillGate makes all reasonable attempts to exclude viruses from the Web Site, it cannot ensure such exclusion and no liability is accepted for viruses. The User is recommended to take appropriate measures to protect itself against the risk of virus contamination.

7. SkillGate and the Organisation may from time to time make changes to the Agreement. SkillGate is not required to advise Users of any such changes except in so far as they may affect these Terms and Conditions of Use.

Refund Policy

Online Courses:

We offer a 14 day money back guarantee on our courses and a refund will be issued if:

• you have requested it within the 14 day cooling off period
• you have not completed (or attempted to complete) the course(s) and any tests
• you have not received a Certificate of Achievement or Statement of Participation (whether digital or physical) on the course.

The 14 days cooling off period begins from the day you made the purchase.

Once your access to the paid course run has been removed, you will not be able to access any part of the course, take part in any tests, or receive a digital or printed certificate for the course run.

If you change your mind:

You are eligible for a full refund if you cancel your order as long as you have not completed (or attempted to complete) the course and any tests.

Classroom Courses:

We offer a full refund on any classroom courses up to 14 days before the classroom course date. If within 14 days of classroom course date, you can move your booking to another date up to 48 working hours before the classroom start date.

After this time, you will not be eligible for a refund and will need to repurchase the classroom course for a future date.
